The alleged leader of MS-13 asks the judge for the judge after the DOJ moves to dismiss the case

A Salvadoran man alleged by the Attorney General of the United States, PAM Bondi, is a main leader of the MS-13 gang is asking a judge not to dismiss a criminal case against him, despite the Department of Justice that on the early Wednesday that seeks to end the case in favor of deporting the United States.

Henrry Josue Villatororo Santos, who is alleged that he is in the United States illegally, is asking a judge magistrate in the United States District Court for the East district of Virginia that delay dismissal because he fears that the United States government will move immediately to deport him to the CECOT prison in El Salvador without the opportunity for due process.

Villatoro Santos was arrested at a residence in Virginia on March 27 in a very publicized operation in the morning. After he was arrested for an administrative order of pending immigration, a search in his room appeared weapons and “Indicia of the MS-13 Association”, according to an affidavit of an immigration and customs officer of the United States Customs.

Villatoro Santos was accused in the Federal Court of illegal possession of firearms and was ordered to hold on trial.

On Wednesday morning, the government presented a short motion seeking to dismiss the case. The explanation offered was simple, but lacked details. “The government no longer wishes to follow instant prosecution at this time,” said the motion.

“As a terrorist, he will now face the elimination process,” Bondi said in a statement on Wednesday.

That led to the peculiar circumstance of the accused, Villatoro Santos, asking the court not to end the case immediately.

Elsayed said he was “very aware of the unusual nature” of the motion.

“But these are unusual times,” he wrote, asking the Court to delay the entry of any dismissal order for two weeks to allow Villatoro Santos to be enough time to seek the assistance of immigration lawyers.
